Why is the Attorney General answering a question about local governmental entities regulating liquified petroleum gas?

  • Chair Darby asked for an opinion on the effect of section 113.054 of the Natural Resources Code which states it preempts local regulations of LPG
  • Chair Darby in his request mentions 2 local governments, home rule cities, that aren’t yielding to preemption

The Attorney General Opinion teaches us that home rule cities are permitted to:

  • self-govern BUT the Legislature can limit this by acting with “unmistakable clarity”

The Attorney General answers whether the Natural Reources Code preempts home rule cities on LPG regulations by finding:

  • Preemption is King. Generally, the existence of an unapproved local LPG provision would be preempted
  • State Rules Are the Regulatory Ceiling. Local governments cannot enact less potent regulations
  • Silent State Rules Preempt. When the state has not promulgated a LPG rule, local governments are restrained from adopting rules, because any local rule would immediately be more restrictive than no rule.
  • No local Ordinances are grandfathered. Grandfathering in existing ordinances would frustrate the purpose of statewide regulation in Chapter 113, Natural Resources Code.

What was the case about?  A coalition of energy companies, operating refining facilities in the Greater Houston area, had sued the City of Houston over environmental licensing fees which were used to fund local environmental enforcement investigations.

What did the Texas Supreme Court say?  In a 8-1 ruling, the Court said the Legislature intended statewide enforcement & did not support local criminal penalties without a statewide determination that a violation had occurred.
