COVID Liability Legislation. Where are we?

States are limiting liability related to COVID in varying ways, here’s the latest sampling:

• NEVADA provides limited liability for businesses that are in substantial compliance with safety regulations and orders SB 4 (2020 | NV)
• LOUISIANA offers limited liability to schools and charter schools + colleges and universities if HB 59 (2020 | LA)
• TENNESSEE doubled up on immunity for governmental entities SB8009 (2020 | TN)
• VIRGINIA is extending limited liability protection for the PPE industry SB5098 (2020 |VA)
• MICHIGAN granting limited liability protection for PPE industry, cleaning and disinfecting supply industry & the insurance policies that extend to all of these SB 1024 (2020 | MI)

All of these share the common attribute that protection does not extend to gross negligence, willful, wanton, intentional …the usual suspects of legalese.
