Taxing Streamers & Satellites

What is happening? New York is considering  S.9254 (2022 | NY) would tax direct broadcast satellite and video streaming services. The tax would align with the 5% tax cable providers pay in New York.

Why is this important? Many states and local jurisdictions are trying to figure out how to make up for lower cable tax revenues when everyone streams or uses satellite services.

How will this be important? Courts are siding with streamers. The business models of how cable & streamers distribute programming are different. This is also highlighted by a case in Ohio that hinges on the argument that Ohio’s law only covers companies building infrastructure to carry cables.
