Unintended Consequences of State Preemption

What is happening?  University of Virginia law professor Richard Schragger talks the consequences of state preemption on local governments. Laws with unintended consequences…surprise surprise surprise.

Why is this important? Historically state intervention in local land use has been detrimental to minority communities and poor communities

How will this be important? The greatest impact is to affordable housing, the law professor says states are more reticent of affordable housing than most local governments which leads to more gentrification when the state is in control of land use.
