Summer of 2020 shall be defined by the Black Lives Matters.
So, along comes this question to the Texas Attorney General: What duty does an officer have to intervene if he sees another officer violating someone’s rights.
The answer, in Texas: Can’t say that there is an “absolute duty for an officer to intervene”
It gets muddier- the opinion says maybe there is a duty, but it’s a question of fact and our opinions don’t answer questions of fact.
What you need to know: The code sections that would be amended to change this answer: Code of Criminal Procedure article 2.13, Penal Code section 39.03
