The Attorney General Opinion teaches us that home rule cities are permitted to:

  • self-govern BUT the Legislature can limit this by acting with “unmistakable clarity”

The Attorney General answers whether the Natural Reources Code preempts home rule cities on LPG regulations by finding:

  • Preemption is King. Generally, the existence of an unapproved local LPG provision would be preempted
  • State Rules Are the Regulatory Ceiling. Local governments cannot enact less potent regulations
  • Silent State Rules Preempt. When the state has not promulgated a LPG rule, local governments are restrained from adopting rules, because any local rule would immediately be more restrictive than no rule.
  • No local Ordinances are grandfathered. Grandfathering in existing ordinances would frustrate the purpose of statewide regulation in Chapter 113, Natural Resources Code.

What’s this business about Texas law being unsettled on this issue? The bankruptcy judge called this issue, whether the piepline contracts are tied to the land and thus not excusable in bankruptcy court, is unsettled in Texas law.
